This happens when an individual is unable to make sound decisions for themselves due to various reasons like age, illness, or disability.

What are the different types of conservatorships?

Ted: There are several types, each tailored to specific situations. You have Conservatorship of the Person, which focuses on the individual’s personal needs – housing, healthcare, daily care and so on. Then there’s Conservatorship of the Estate, dealing with finances, assets, and paying bills. For folks with developmental disabilities, we have Limited Conservatorships granting specific powers based on their needs. Temporary Conservatorships are for urgent situations while a full hearing is scheduled. And finally, LPS Conservatorships are for individuals needing involuntary treatment due to serious mental health conditions.

What’s the most challenging part of the conservatorship process, in your experience?

Ted: Hmm, great question! I’d say establishing a conservatorship can be tricky. It requires a lot of paperwork and legal maneuvering. Ensuring all parties are notified correctly, conducting thorough investigations – those steps take time and precision.

Remember, we’re dealing with sensitive situations involving vulnerable individuals. Every decision must be made with their best interests in mind. This can lead to complex ethical considerations that need careful navigation.

Have you ever encountered any unique challenges during the establishment phase?

Let me tell you about a case I handled a few years back. We were trying to establish a conservatorship for an elderly gentleman suffering from dementia. He had substantial assets but no close family. Locating distant relatives proved to be quite a puzzle!
