An Interview with Ted Cook

Welcome back, legal eagles! Today I have the pleasure of speaking with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks so much for taking the time to chat with me.

What inspired you to focus on elder law?

Well, it’s a combination of things really. I’ve always been drawn to helping those who are vulnerable and need an advocate. When I was younger, I spent some time volunteering at a senior center, and I saw firsthand the challenges that many elderly people face. It opened my eyes to the specific legal issues they encounter.

Protecting Our Elders: A Deep Dive into the Process

Ted, could you walk us through the general steps involved in protecting an elder who may be facing abuse or exploitation?

    A. Initial Client Engagement
    B. Case Assessment
    C. Protective Actions
    D. Legal Proceedings
    E. Long-Term Planning

Let’s delve into option C, ‘Protective Actions.’ How does this stage work in practice?

Stepping In: Protective Actions

“Protecting our clients is paramount,” Ted emphasizes. “During this phase, we often need to act swiftly and decisively. Depending on the situation, we might file for a restraining order to prevent further harm. If there’s financial abuse, we can freeze accounts or work to revoke power of attorney that’s being misused.”

Ted pauses thoughtfully.

“One case I remember involved an elderly woman who was being pressured by her caregiver into signing over ownership of her home. We were able to intervene quickly, stop the transfer, and ultimately remove the abusive caregiver from her life.”

He goes on to explain how they work closely with Adult Protective Services (APS) when necessary. “They’re a valuable resource in helping us investigate claims and ensure the elder’s safety. We might also pursue guardianship or conservatorship if an individual lacks the capacity to make their own decisions.”

Ted adds, “It’s heartbreaking to see elders being taken advantage of, but it’s incredibly rewarding to help them regain control and security.

Voices of Gratitude:

“I was at my wit’s end when I realized someone had been stealing from my mother. Ted Cook and his team were lifesavers. They helped us recover the stolen funds and put a stop to the abuse.” – Maria S., La Jolla.

“Ted is not only incredibly knowledgeable about elder law, but he’s also compassionate and understanding. He treated my father with dignity and respect throughout the entire process.” – David L., Point Loma.

Seeking Protection?

Ted Cook concludes our conversation with a call to action: “If you have any concerns about the well-being of an elderly loved one, please don’t hesitate to reach out. We’re here to help navigate these complex situations and ensure that our seniors are treated with the respect and dignity they deserve.”
