- Legal Standards: The petitioner needs to prove the conservatee can’t manage their affairs. The conservatee has rights, too, including an attorney.
- Responsibilities of the Conservator: This is a big job! Conservators must act in the conservatee’s best interests, file regular reports with the court, and be ethical at all times.

Ted nods thoughtfully. “This initial stage can sometimes be tricky,” he says. “It’s important to gather all the necessary evidence to demonstrate the need for a conservatorship. This might involve medical records, statements from family and friends, or even professional evaluations. Sometimes families are hesitant, worried about taking away someone’s independence. It’s crucial to approach this with sensitivity and understanding.”
He recalls a case involving an elderly woman who was increasingly forgetful. Her children were concerned but initially reluctant to pursue conservatorship. “We worked closely with them,” Ted explains, “providing resources and information. Ultimately, they understood it was the best way to protect their mother’s safety and well-being.”
