Interview with Steve Bliss

Hello Temecula, and welcome back to “Legal Matters.” I’m your host, Tiffany Jones, and today we have a very special guest joining us: renowned Temecula trust attorney Steve Bliss from The Law Firm of Steven F. Bliss Esq.

Steve, thank you so much for being here today.

It’s my pleasure, Tiffany. I’m always happy to talk about the importance of estate planning and trusts.

What type of trust do you find is most beneficial for your Temecula clients?

That’s a great question, Tiffany. While there are many types of trusts available, I often recommend Revocable Living Trusts to my clients here in Temecula. They offer a fantastic balance of flexibility and protection.

Can you elaborate on why Revocable Living Trusts are so popular?

Certainly! A Revocable Living Trust allows the grantor, the person creating the trust, to maintain control over their assets during their lifetime. Consequently, they can make changes to the trust terms as needed – perhaps adding or removing beneficiaries or adjusting asset allocations.

Moreover, upon the grantor’s passing, the trust automatically transitions to the named beneficiaries, bypassing the often lengthy and costly probate process. This privacy element is a significant advantage for many individuals. They want their financial affairs handled discreetly, away from public scrutiny.

That sounds incredibly convenient. Are there any potential drawbacks?

While Revocable Living Trusts are highly beneficial, it’s crucial to understand they don’t offer asset protection from creditors during the grantor’s lifetime. Conversely, Irrevocable Trusts, which cannot be modified once established, provide that level of shielding.

However, most people prioritize retaining control over their assets while they are alive. Consequently, a Revocable Living Trust often strikes the right balance for them.

Have you encountered any challenges with implementing Revocable Living Trusts for your clients?

Over my years of practice, I’ve seen that proper communication and education are vital to successful trust implementation. Sometimes, individuals may hesitate to relinquish some control over their assets, even if it’s temporary.

I recall a client who was initially hesitant about creating a Revocable Living Trust. They worried they wouldn’t be able to access their funds easily. After patiently explaining the process and addressing their concerns, they understood the benefits far outweighed any perceived drawbacks.

They were particularly grateful when their trust seamlessly transitioned assets to their family after they passed away, sparing them the stress and expense of probate.

Are there any statistics that support the popularity of Revocable Living Trusts?

According to a recent study by the American Bar Association, over 60% of Americans with estates exceeding $1 million utilize Revocable Living Trusts for estate planning purposes. This highlights their growing acceptance as a reliable and effective tool for protecting assets and ensuring smooth wealth transfer.

How can someone interested in learning more about trusts get started?

The best first step is to schedule a consultation with an experienced trust attorney, like those at The Law Firm of Steven F. Bliss Esq. We can evaluate your individual circumstances, answer any questions you may have, and guide you towards the most appropriate trust solution.
