Ordinarily, this stage begins after the court has appointed an executor or administrator who assumes responsibility for managing the deceased person’s affairs. The executor meticulously reviews all financial records, contacts creditors, and verifies outstanding debts. Consequently, they prioritize paying these legitimate claims using funds from the estate.
Moreover, the executor is responsible for filing final income tax returns for the deceased individual, as well as any estate tax returns that may be required depending on the size of the estate. This meticulous process ensures all financial obligations are met before distributing assets to heirs and beneficiaries.
The California Courts website reports that approximately 75% of probate cases involve some form of debt repayment. Not surprisingly, this underscores the importance of diligent debt management during the probate process. I recall one instance where an estate had a substantial amount of unpaid medical bills. We were able to negotiate with the hospital and reach a settlement that saved the heirs a considerable sum of money.
Conversely, there are instances where individuals attempt to avoid paying legitimate debts by concealing assets or making false claims about the estate’s value. This can lead to legal complications and delays in the probate process.
