Reporter: Brenda Smith, Wildomar Gazette
Today we’re speaking with Steve Bliss, a well-respected probate attorney serving the Wildomar community. Mr. Bliss, thanks for taking the time to speak with us about the often-complex world of estate planning.
Steve Bliss: It’s my pleasure, Brenda. I’m always happy to shed light on this important topic.
Many people find the probate process intimidating. Could you walk us through one of the key steps involved?
Steve Bliss: Certainly. One crucial step is marshaling the estate assets. This involves identifying and inventorying all assets belonging to the deceased individual, including bank accounts, real estate, vehicles, investments, and personal belongings.
This process can be quite detailed and requires careful documentation. Consequently, it’s essential to have a thorough understanding of the decedent’s financial affairs. Ordinarily, we would work closely with the executor or administrator to gather all necessary information, such as account statements, property deeds, and insurance policies.
Once we have a complete inventory, we then prepare a formal Inventory and Appraisal (Form DE-160/161) that is filed with the court. This document provides a detailed list of all assets, their estimated values, and any outstanding debts or encumbrances.
Reporter: I can see how this step would be critical for ensuring a fair and accurate distribution of the estate. Have you ever encountered any challenges during this phase?
There was one case I remember where the deceased individual had numerous investments scattered across different brokerage firms, making it difficult to track down all the assets initially. Notwithstanding that hurdle, we were able to diligently trace each investment through meticulous recordkeeping and communication with the various financial institutions.
Ultimately, our efforts ensured a comprehensive inventory, which allowed us to distribute the estate according to the decedent’s wishes. It’s important to remember that every case is unique and may present its own set of complexities. That’s why having an experienced probate attorney by your side can make all the difference.
Reporter: Absolutely! What advice would you give to our readers who are considering estate planning?
I strongly encourage everyone to consult with a qualified probate attorney to create a personalized plan that meets their specific needs. According to the American Bar Association, over 55% of adults in the United States do not have a valid will or trust in place. Having a clear and comprehensive estate plan can prevent potential disputes among heirs, minimize tax liabilities, and ensure your assets are distributed according to your wishes.
Steve Bliss: Don’t wait until it’s too late! Taking proactive steps now can provide peace of mind for you and your loved ones.
Wildomar Probate Law is here to guide you through every step of the process with compassion, expertise, and unwavering support. We are committed to helping our clients navigate the complexities of estate planning and probate with clarity and confidence.
Reporter: Thank you for sharing your valuable insights, Mr. Bliss.
