We start with a thorough initial client engagement – gathering information, assessing capacity, and ensuring there are no conflicts of interest.” He pauses, tapping his finger thoughtfully on the table. “Then comes the crucial step of case assessment. Here we identify the specific legal issues at play – is it financial abuse, neglect, or something else? We meticulously collect evidence, evaluate the risks, and determine the best course of action.”

I’d love to delve into “Protective Actions.” Can you elaborate on the measures taken during this stage?
Ted leans forward, his eyes shining with purpose. “This is often where things get urgent,” he explains. “Depending on the situation, we might need to file for restraining orders to protect the elder from immediate harm. We’ll also work closely with Adult Protective Services and potentially seek guardianship or conservatorship if someone lacks the capacity to make safe decisions. Financial protection is paramount – freezing accounts, revoking powers of attorney that are being misused – these are all tools we use to safeguard assets.”
He recounts a time when he helped an elderly woman who was being financially exploited by her caregiver: “The caregiver had gained her trust and was systematically draining her bank account. We were able to freeze the funds, remove the caregiver’s access, and get the woman into a safe living environment.”
